Step-by-Step Claim Process

Contact Microsoft's Legal Department or submit an inquiry through their estate support portal.

Serve a formal subpoena or court order on Microsoft's registered agent in your state or region, specifying the required data (e.g. Outlook emails, OneDrive files). Microsoft does not accept these by fax or email.

Provide the email address associated with the Microsoft account.

If Microsoft's legal team accepts the order, they may release the data — Microsoft states it can still be unable to provide account content even with a valid court order.

To close the account without a subpoena, you can request account deletion by presenting the death certificate.
